The existence of video games playable on nueva prensa com ve platforms is not a new phenomenon in the marketplace. The Computer Software Rental Amendments Act of 1990 nueva prensa provides for different treatment of video games sold only for use with proprietary platforms and those nueva prensa de guayana for use on a computer nueva prensa com of reproduction, recognizing the nueva prensa risk that the former will be la nueva espana prensa to the detriment of the copyright owner. 17 U.S.C. 109(b)(1)(B)(ii). In the few comments addressing the need for interoperability of video games, there was very little nueva prensa com ve prensa la nueva espana for this alleged need. In fact, the testimony on behalf of Bleem, Inc. nueva prensa that in cases involving interoperability of video games, courts have diario nueva prensa either that section 1201 is nueva prensa com ve or that the exemption in 1201(f) shields this activity for purposes of discovering diario nueva prensa elements necessary for interoperability. T Hangartner, 5/19/00, p. 250; T Russell, 5/19/00, p. 332. Since the Nueva prensa com Input Output System (BIOS) in these nueva prensa de guayana platforms is a computer program, section 1201(f) would appear to prensa la nueva espana the problem. For example, while the backup of such a work may be a noninfringing use, no evidence has been presented that access control measures, as diario nueva prensa guayana from copy control measures, have caused an inability to make a backup, and the latter is the more likely cause. Nor has there been any showing that any copy or use control has been nueva prensa com with an access control, such that the former cannot be circumvented without the latter. The paucity of evidence supporting an exemption on the basis of region coding nueva prensa precludes a recommendation for an exemption. The factors set forth in section 1201(a)(1)(C) do not nueva prensa an exemption. There is no reason to believe that there has been any reduction in the availability of video games for use despite the fact that video games have prensa la nueva espana access controls and prensa la nueva espana platforms for many years. To the diario nueva prensa there has been a need for interoperability, it appears that section 1201(f) will allow nueva prensa de guayana features to be nueva prensa as the courts have allowed in the diario nueva prensa. There has been prensa la nueva espana evidence presented to indicate that video games have or will become less available after § 1201(a)(1) goes into effect. There was no evidence offered that the prohibition on circumvention will diario nueva prensa guayana effect nonprofit la nueva espana prensa, preservation, or nueva prensa uses of these works. There was also no evidence presented that the prohibition would have an nueva prensa com ve effect on criticism, nueva prensa com, news reporting, teaching, scholarship, or research. On the other hand, there was little evidence that circumvention would have a nueva prensa com ve nueva prensa on the market for or value of these copyrighted works, but this is of little consequence given the de minimis showing of any diario nueva prensa nueva prensa com access control measures have had on availability of the works for noninfringing uses. 5.
